課程概述	新康德主義是十九世紀到廿世紀最重要，卻也是後世最被忽略的哲學思潮。東亞繼受的德國現代法學（以及相關法學思想），也受到新康德主義相當強的影響，然而至少在台灣，卻少有人注意並研究此一思想脈絡。本課程嘗試透過文獻閱讀，尤其聚焦Radbruch與Lask兩位法哲學家的著作，來對此一問題進行瞭解與思考。賴德布魯赫的法哲學，在當代主要透過Radbruch公式而獲得討論與繼受。不過其思想其實遠比這個公式複雜而豐富。因此建議先「放下Radbruch公式！」。本人認為，不放下這個公式（及其相關討論），並嘗試從新康德主義哲學入手，恐怕無法真正掌握賴德布魯赫思想的精髓與精彩之處。
課程目標	透過研讀文獻，初步掌握Radbruch以及Lask兩位新康德主義法哲學家的理論要點。主要進度： ◎概述 ◎規範性 ◎新康德主義的當代研究 ◎賴德布魯赫的法哲學 ◎拉斯可的法哲學 ◎綜合討論
課程要求	修課條件: 應具英文閱讀基礎。成績考核: 至少一次期中報告；一次期末考試其他要求: 積極參與討論
